Mandatory Reporting Channels

Obligation to Create Mandatory Reporting Channels

Under PT Law 93/2021, any organization in Portugal employing 50 or more people must establish a secure internal reporting system.

These channels provide employees, contractors, and stakeholders with a confidential and structured way to report misconduct, breaches, or illegal activities, helping organizations address issues proactively.

Internal channels must be accessible, reliable, and equipped to handle reports efficiently. External reporting is reserved only for cases where internal systems are unavailable, ineffective, or pose risks to the whistleblower, ensuring safety and compliance at all times.

Smaller organizations with 50–249 employees can share reporting resources, while certain local authorities with fewer than 10,000 residents may be exempt.

Failure to meet these requirements can result in administrative sanctions, financial penalties, and reputational damage. A properly implemented reporting channel not only fulfills legal obligations but also reinforces organizational integrity, builds trust with employees, and encourages a culture of transparency.
